Text messages are a common means of communication among private subscribers although businesses are coming up rapidly to reap from the service. When the send text message service between business and mobile phone subscribers became evident, there was a need for short message gateways to control the resultant traffic. The main reason why the gateways were established was also to carry critical mission messages, for entertainment and for content delivery. Media agenda voting especially on radio and television heavily depends on this service to know more about the audience opinions. The gateway providers are categorized as mobile phone aggregators.

Different countries have varying legislations when it comes to information and communication and they have to be respected. For that reason, to send text message can make it be availed in court as a source of evidence against communication related crimes.

Abusive text messages intended for this purpose should be handled with care. The justification for government control over text messages and any other communications is that this is usually the womb in which crime is conceived. It is unaccepted to personally send text message while driving. Such a behavior will often cause accidents because of the reduced attention on the road and the result is that the country loses its manpower apart from people being left orphaned and widowed.

The send text message service, or SMS, which was widely used by criminals in planning and conducting crime, should be considered as overtaken by events. In the world today, mechanisms to track messages exist. A British company in 2003 developed the Fortress program used alongside Symbian phones which used encryption to protect text messages.

This program is used by police to retrieve deleted text messages both sent and received for their investigations against crime. A good example is when the police were able to get back text messages that were evidence against Sara Syenson after she had admitted a murderer of Pastor Fossmo Helge's wife and shooting Linde Knutby, lover's husband in Sweden. The messages had been acted anonymously. In another instance in Malaysia, a court ruled that there is no legal provision that allows divorce by sending text messages.
